The services and products provided by TulipPhotography are done so using these Terms and Conditions. Services are provided by our website, face to face and via the telephone. Please note our Terms and Conditions may vary from time to time, without any notice to you, though we will try to update them as soon after any changes are made.
When you place an order through any of our channels these Terms and Conditions will apply.

Description of Services
Our packages, frames, canvasses, digital products and gift ideas are outlined on our order form and product list. As much detail as possible is provided ref the sizes, quantities, colours etc to provide you with as much information as possible to make your choice. We may remove or decide to change our packages or products on our order form from time to time. Certain products are subject to their own Terms and Conditions (see below).
We will show 3 portraits per child (2 portraits for school photography) . If our order form does not meet your requirements then customers can attach a separate note with their requests.
We cannot guarantee that we will be able to take every child’s portrait at the school/nursery or group or if portraits are taken we cannot guarantee that the quality will be of our normal high standard that we would wish to sell them. We are unable to accept liability for loss of portraits due to photographers actions or equipment malfunction. We may choose to re-attend the school, nursery or group to re-take portraits, but this will be at our discretion.

Photographers
Our photographers will have been CRB checked, and on request will be able to demonstrate this. Any inappropriate actions/misconduct by our photographers will be dealt with harshly either by means of a disciplinary or instant dismissal if necessary.

Prices
Our prices are outlined on our order form. Prices are subject to change at our discretion, but will not change during a season or when an order has been placed.
We may alter the package contents and prices to suit a school or groups requirements, at our discretion.

Commission
Commission is payable to each school, nursery or group at a rate agreed between us. This rate may vary between schools. To comply with accounting laws we will send each school, nursery or group an invoice outlining the commission payable to them.
If a customer fails to pay for an order, and we have been unable to secure payment then at our discretion we may deduct the order value from the school/nursery or groups commission.

Recommendations
We offer incentives to anyone who recommends us to another school, nursery or group. We must make a booking at the school, and they must have a minimum of 15 children, before any incentive is given. No booking no incentive. Incentive offers are subject to change without notification.

Frames and Canvasses
As all our frames and canvasses are hand-made to order, we cannot offer refunds or exchanges on any of these products, unless they are damaged. If frames or canvasses are unable to be delivered to the school, nursery or group then we may choose to deliver them by other means, ie use of the postal service or by a member of our staff.
The chunky wood effect frame comes mounted with 3 10x8 portraits, and is available in 3 colours. These portraits can be from any of your child’s / children’s order forms. We cannot guarantee that our colour description will match your expectations.
Our square frame comes in 2 sizes and 4 colours. Again we cannot guarantee that our colour description will match your expectation.
We may advice you additional P&P charges when ordering frames.
Our canvasses various sizes. Some portraits are better suited to a specific size ie standing up pose is best displayed on an A3 canvas. Customers should call for advice if they are not sure what size is best.
All our products and print sizes are in inches (errors and omissions accepted on our order form and product list).

Go Digital
The 3 portraits from one order form (or 2 portraits for schools) taken by Tulip Photography will be supplied on a CD. These pictures come with copyright release so customers have the flexibility to print them at their leisure.

Mouse Mats and Keyrings
No refunds or exchanges unless faulty. Minimum order of 2 keyrings. Please note mouse mats are not printed.

Gifts
Images of gifts shown on our web site are for guide only and the supplied products may vary slightly in design to those shown.


Packages/Single Prints
Pick&Mix packages – Pick&Mix any of your portraits from ONE order form only. Images cannot be mixed between order forms.
Bumper, Gift and Saver packages – these packs contain different size photos of ONE portrait only.

We offer varying sizes of single prints (minimum purchase 2 x 7’x5’s).

Refunds will be at our discretion.

Discounts
We do not offer discounts (except on Digital products).

We may discontinue providing certain products, or all of the above products, at our discretion and without notice.

Payment Methods
We offer a selection of payment methods – cash, cheque or credit card. Credit card details will be destroyed once payment has been taken.
Cheques – name, address and the reference of the portrait ordered must be written on the back of all cheques. This allows the cheque to be traced back to the order. Please ensure you have adequate funds as bounced cheques incur a £7.50 charge.
Payment must be made in full before any order is processed/despatched. If payment fails after an order has been despatched then we will seek to recover the costs at our discretion. We also reserve the right to refuse to take a child’s portrait if previous orders for that child have not been paid for.

Late Orders
If an order has not been returned to the school, nursery or group by the deadline, then late orders can be posted to Tulip Photography, The Potteries, Langford Road, Weston-super-Mare, Somerset BS23 3PQ.
Late orders will incur a charge of £2.25.

Refunds
Refunds or exchanges are not permitted unless our products are faulty. We cannot accept responsibility for orders posted which may arrive damaged due to the Post Office. We will only accept liability if the damage is caused by our packaging. Refunds or reprints of portraits damaged by the Post Office are at our discretion. We will request that any damaged portraits be returned to us (by 2nd class post), before we replace them.

Your Details
Your contact details are only used by Tulip Photography and Epic Photography. Tulip Photography only use your details if an order needs posting or there is a query. Epic Photography will only use your details to contact you with reference to their services. Only those who have not ticked the “I do not wish to be contacted by Epic Photography' box will be contacted.

Security
Your portraits will be kept on our computers for a minimum of 3 years. If for any reason whatsoever a portrait is lost or deleted from our computer systems then we hold no responsibility for this. Portraits will not be used by anyone outside Tulip Photography or Epic Photography. We may at times use any portrait in our marketing or advertising literature, and where possible we will seek parents/gardian's permission.

Code of Conduct
You are responsible for what you order and its payment. We cannot be responsible for orders lost in the postal system.
You are not permitted to use our web site or any of our products for any reason or purpose that is unlawful, defamatory, harmful or objectionable.
You are not permitted to order portraits from our website or via post if you do not have a clear right to do so.
You must ensure that you do not misuse any portraits or files which may be considered unlawful.
Other than as expressly permitted by us, you are not permitted to copy or print portraits where you do not have the copyright.
Proprietary Rights and Licences
All text, portraits, graphics, page layouts, design and other material that is contained on our web site or on our order form/product list is part of our service, and is protected by our and their copyrights, trademarks, service marks, patents or other proprietary rights and laws.

Indemnity
You agree to indemnify us and hold us harmless from and against any claims, actions or demands (including any legal fees incurred in connection therewith) resulting from misuse of our products or services or breach of these terms and conditions.

General
These terms and conditions constitute the entire agreement between us in respect of the use of our services and of our web site and supersede any and all prior agreement, arrangements and representations (save in respect of those made fraudulently).

Tulip Photography accepts only one currency. This currency being Great British Pounds (Pounds Sterling). All information passed to us with regards to payment will be kept safe or destroyed with the strictest security at all times.

If any of these terms and conditions are found to be invalid then that provision shall not affect the validity of the remaining provisions, which shall remain fully enforceable. No waiver by us of any term shall be deemed to be continuing or shall be deemed to be a waiver of any other term.

These terms and conditions will be interpreted and construed in accordance with the Laws of England and Wales and will be subject to the non-exclusive jurisdiction of the English Courts.
